New I-9 Form: What Changed?

The new I-9 form has been issued!

May 1, 2020 - Must use new I-9 form, dated 10/21/19.

April 30, 2020 - Last date to use the I-9 form dated 7/17/17.

What’s new?

There are no changes to the paper version of the I-9, but minor changes are found in the electronic version.

Take note: The new form clarifies direction on who can act as an authorized employer representative in completing the I-9 in instances where remote employees are hired. Such designated authorized representatives still bind the employer for any violations in the I-9 requirements. 

The new electronic form also:

  • Lists additional countries in the “Country of Issuance” field in Section 1;

  • Establishes that writing “N/A” in the fields for either List A columns or List B and C columns (whichever is not being used) is no longer required;

  • Clarifies that List C documents (which establish employment authorization) do not include a worker's Employment Authorization Document (EAD). The EAD (Form I-766) providing temporary employment authorization to work in the United States is a List A document.
